Innovate Web Designs Ltd. ("we", "us", or "our") honors the intellectual property rights of others and anticipates the same commitment from our users. As required by the Digital Millennium Copyright Act of 1998 (the "DMCA"), we are committed to promptly addressing claims of copyright infringement that may occur in relation to our services, provided these claims are directed to our Designated Copyright Agent as outlined in the notice format below.
DMCA Notice of Alleged Infringement ("Notice")
- 1. Specify the copyrighted work you believe has been infringed, or—if this Notice pertains to multiple copyrighted works—provide a representative listing of those works.
- 2. Indicate the material or link that you allege is infringing (or is the subject of infringing activity) and that access should be disabled, including the applicable URL on the Site or the precise location of the material.
- 3. Provide your company name (if relevant), mailing address, contact number, and, if possible, an email address.
- 4. Include both of the following declarations within the Notice:
- * "I affirm that I have a sincere belief that the use of the copyrighted material in dispute is not permitted by the copyright owner, their representative, or the law (such as under fair use)."
- * "I affirm that the details provided in this Notice are accurate and that, under penalty of perjury, I am the copyright owner, or am authorized to act on behalf of the copyright owner or hold an exclusive right under the copyright that is allegedly infringed."
- 5. Include your full legal name along with your electronic or physical signature.

It is important to note that under Section 512(f) of the DMCA, anyone who knowingly misrepresents that material or activity is infringing may face legal repercussions.
Counter-Notice
If you believe that your content was incorrectly removed (or access to it was disabled) and that it doesn't constitute infringement, or if you possess authorization from the copyright owner or their agent, you may submit a counter-notice to our Designated Copyright Agent. This counter-notice should include the following details:
- 1. Your physical or digital signature;
- 2. Identification of the content that was removed or disabled, along with the location where the content appeared prior to removal or disabling;
- 3. A statement asserting your good faith belief that the content was removed or disabled due to an error or misidentification;
- 4. Your name, address, phone number, and email address, a statement consenting to the jurisdiction of the federal courts in Seychelles, and an acknowledgment that you will accept service of process from the party who provided the notice of alleged infringement.
Upon receiving a counter-notice, we may inform the original complainant that we might reinstate the removed content or cease disabling it within 10 business days. Unless the copyright owner commences an action seeking a court order against the content provider or user, reinstatement or restoration of access may occur within 10 to 14 business days, at our discretion.
Policy for Repeat Infringers
In accordance with the DMCA and other relevant legislation, we have enacted a policy to terminate, at our sole discretion, users identified as repeat infringers in appropriate circumstances. We also reserve the right to restrict access to the Site and/or terminate accounts of those who infringe the intellectual property rights of others, regardless of repeat occurrence.
